Welcome to Means A Lot. These Terms of Service ("Terms") govern your access to and use of the applications, websites, and services operated by Means A Lot LLC ("we," "us," or "our"), including EMDRly, LifeTimeline, MemoryKeeper, and meansalot.com (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
Use of Services
You may use our Services only if you are at least 13 years of age (or the minimum age required in your jurisdiction) and are not barred from using the Services under applicable law.
You agree to use our Services only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs under your account.
Accounts
Some of our Services require you to create an account. When you do:
- You must provide accurate and complete information
- You are responsible for maintaining the security of your account credentials
- You must notify us promptly if you suspect unauthorized access to your account
- You may not share your account with others or create multiple accounts
Your Content
Our Services allow you to create, store, and manage personal content including journal entries, memories, timelines, and other information ("Your Content").
- You retain all ownership rights to Your Content
- You grant us a limited license to store, process, and display Your Content solely to provide the Services to you
- We will not use Your Content for advertising, marketing, or any purpose other than providing our Services
- You can export or delete Your Content at any time
Subscriptions and Payments
Some features of our Services require a paid subscription. For paid subscriptions:
- Pricing and payment terms will be clearly presented before purchase
- Subscriptions may auto-renew unless you cancel before the renewal date
- You can cancel your subscription at any time through your account settings or the App Store
- Payments are processed by Stripe (for web purchases) and Apple (for in-app purchases)
Refunds
For purchases made through the App Store, refund policies are governed by Apple's terms. For web purchases processed through Stripe, please contact us at support@meansalot.com to request a refund within 30 days of purchase.
Prohibited Uses
You agree not to:
- Use our Services for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of our Services
- Upload or transmit viruses, malware, or other harmful code
- Scrape, crawl, or otherwise extract data from our Services through automated means
- Use our Services to harass, abuse, or harm others
- Impersonate any person or entity
- Reverse engineer, decompile, or disassemble any part of our Services
Medical and Health Disclaimers
Some of our applications (including EMDRly) are designed to support individuals engaging in therapy or mental health treatment. It is important to understand:
- Our Services are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition
- Our Services are not a substitute for professional medical advice, diagnosis, or treatment
- Always seek the advice of your physician or qualified mental health provider with questions regarding a medical condition
- If you are in crisis, please contact the 988 Suicide & Crisis Lifeline (call or text 988) or your local emergency services
Intellectual Property
The Services, including all software, design, text, graphics, and other content (excluding Your Content), are owned by Means A Lot LLC and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, or create derivative works based on our Services without our prior written consent.
Copyright Policy
We respect the intellectual property rights of others. If you believe that any content on our Services infringes your copyright, please send a notice to support@meansalot.com with the following information:
- A description of the copyrighted work you claim has been infringed
- A description of where the allegedly infringing content is located
- Your contact information
- A statement that you have a good faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information in your notice is accurate
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or secure, or that defects will be corrected.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEANS A LOT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.
Indemnification
You agree to indemnify and hold harmless Means A Lot LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.
Termination
We may terminate or suspend your access to our Services at any time, with or without cause, upon notice. Upon termination:
- Your right to use the Services will immediately cease
- You may request export of Your Content within 30 days of termination
- We will delete Your Content from our servers within a reasonable period, subject to legal retention requirements
You may terminate your account at any time by contacting us or through your account settings.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved in the courts of the United States.
Changes to These Terms
We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and, where possible, through the app. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the changes.
